Heidi Montags sex tape “scandal” is a lie of course

You would think this would go without saying, but you can’t go around selling movies of people having sex without their consent. Sexually explicit pictures or video has to meet very strict laws. That’s why I can’t sell my documentary called, “My Neighbor Tans Topless”.

So when news broke that Heidi Montag had a sex tape for sale, some of it even lesbian stuff with Playmate Karissa Shannon, very obviously they were a part of it.

Federal law demands that anyone who produces porn must keep strict records of every performer. In part, 2257 says…

Whoever produces any book, magazine, periodical, film, videotape, digital image, digitally- or computer-manipulated image of an actual human being, picture, or other matter which … contains sexually explicit conduct … shall create and maintain individually identifiable records pertaining to every performer portrayed in such a visual depiction.

This means that every person who has sex in porn has signed paperwork stating who they are, they’re real age, real name, and agreeing to be in the movie.

Brandy Ledford was 24 when she appeared in the sex tape with Vince Neil and Janine Lindemulder. She was a well known model in LA, easily identifiable and it would have been simple to verify her age. But she didn’t sign the 2257 paperwork, so her image was blurred out when the sex tape was released. If Heidi doesn’t want the tape released, all she has to do is not sign anything, and then the footage will be worthless. Radar Online says much of the same today…

Multiple legal experts have confirmed that all parties involved in a sex tape must consent to the release or else it is a slam-dunk lawsuit for the party that didn’t consent. If the tape is released, the party who hasn’t agreed can sue for invasion of privacy and a host of other legal issues. And they are nearly guaranteed of a huge court victory.

And now TMZ says Heidi is negotiating with Vivid to put a price on her dignity, to settle on a figure to buy and release the tape. And it better be a lot. If I were a girl and I ever had sex with a douche like Spencer Pratt, the last thing I would ever do is tell someone about it.
